By accessing or using PineForest, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms.

If you are using PineForest on behalf of a business or organization, you represent and warrant that you have authority to bind that entity to these Terms, and "you" will refer to that entity.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or through the Service.

Description of Service

PineForest provides a software-as-a-service platform that enables businesses to:

• Plan, create, and schedule social media campaigns and posts
• Generate marketing content using artificial intelligence
• Manage and organize social media content across multiple platforms
• Analyze and track social media performance and engagement
• Connect and manage social media accounts (Instagram, Facebook, LinkedIn, etc.)

Service Availability: We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Third-Party Services: PineForest integrates with third-party services (such as social media platforms) to provide functionality. Your use of these third-party services is subject to their respective terms and conditions.

User Accounts and Responsibilities

Account Creation: To use PineForest, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Account Security: You are solely responsible for all activities that occur under your account. You agree to:

• Maintain the security and confidentiality of your account credentials
• Notify us immediately if you suspect unauthorized access to your account
• Use strong passwords and enable two-factor authentication when available
• Ensure that all information provided to us is accurate and up to date

Account Restrictions: You may not share your account credentials with others or allow others to access your account. Each account is intended for use by a single business or organization.

Trial Period and Billing

Free Trial: PineForest offers a 30-day free trial period for new users. During the trial period:

• The trial period begins immediately upon signup and lasts for 30 days
• No credit card is required during the trial period
• You may cancel at any time during the trial without charge
• All features and functionality are available during the trial period

Automatic Conversion: At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial period ends. You will be notified via email before the trial period ends.

Billing: Paid subscriptions are billed monthly or annually, depending on your selected plan. You authorize us to charge your payment method for all fees associated with your subscription.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

Refunds: Refunds are handled on a case-by-case basis. Contact support@thepines.ai for refund requests.

Content and Intellectual Property

Your Content: You retain ownership of all content you upload, create, or provide to PineForest ("Your Content"). By using the Service, you grant PineForest a limited, non-exclusive license to use, store, and process Your Content solely for the purpose of providing the Service to you.

PineForest Intellectual Property: The Service, including its design, features, functionality, and all related software, is owned by PineForest and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

Content License: You represent and warrant that:

• You own or have the right to use all content you provide to PineForest
• Your Content does not infringe on any third-party rights, including intellectual property rights
• Your Content complies with all applicable laws and regulations

Content Removal: We reserve the right to remove or disable access to any content that violates these Terms or applicable laws, without prior notice.

Prohibited Uses

You agree not to use PineForest to:

• Violate any applicable laws, regulations, or third-party rights
• Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, or discriminatory
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other accounts or systems
• Use automated systems (bots, scrapers, etc.) to access the Service without our express written permission
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to send spam, unsolicited messages, or engage in any form of harassment

Violation of these prohibitions may result in immediate termination of your account and legal action.

AI-Generated Content

AI Services: PineForest uses artificial intelligence, including Google Gemini, to generate marketing content, images, and other materials. AI-generated content is provided "as is" and may not always be accurate, appropriate, or suitable for your specific needs.

Your Responsibility: You are responsible for reviewing, editing, and approving all AI-generated content before publishing or using it. You should ensure that AI-generated content:

• Accurately represents your business and brand
• Complies with all applicable laws and regulations
• Does not infringe on any third-party rights
• Is appropriate for your intended audience

No Warranty: We do not warrant that AI-generated content will be error-free, accurate, or suitable for any particular purpose. You use AI-generated content at your own risk.

Ownership: You own the AI-generated content created for your account, subject to your compliance with these Terms and applicable third-party terms (including Google's terms for Gemini).

Termination

Termination by You: You may terminate your account at any time through your account settings or by contacting support. Upon termination, your access to the Service will cease, and your account and content may be deleted in accordance with our data retention policies.

Termination by Us: We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, illegal, or harmful activities
• Fail to pay required fees
• Use the Service in a manner that disrupts or harms our systems or other users

Effect of Termination: Upon termination, your right to access and use the Service will immediately cease. We may delete your account and content, though some information may be retained as required by law or for legitimate business purposes.

Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINEFOREST AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Maximum Liability: OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Third-Party Services: We are not responsible for the availability, accuracy, or content of third-party services (such as social media platforms) that integrate with PineForest. Your use of third-party services is at your own risk and subject to their respective terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email to the address associated with your account
• Displaying a notice within the Service

Effective Date: Material changes will become effective 30 days after notification, unless otherwise specified. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.
